  • “You/Your” means the customer purchasing Products or using the Site.

  • “Business Days” means Monday to Friday, excluding Victorian public holidays.

2. Acceptance of Terms

By accessing the Site or purchasing Products, you agree to be bound by these Terms. These Terms form a legally binding agreement.

3. Orders & Contract Formation

  • An order is deemed placed once you complete the checkout process and we receive payment.

  • We reserve the right to accept or reject any order at our discretion (including for stock availability or pricing errors).

  • A contract is formed only once we send you a written confirmation of your order.

4. Pricing, Payment & Taxes

  • Prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated.

  • International customers are responsible for any import duties, customs fees, or local taxes.

  • We reserve the right to update pricing at any time. Orders already accepted will not be affected.

5. Shipping & Delivery

  • Estimated delivery costs are provided at checkout but are not guaranteed.

  • Risk of loss or damage to Products passes to you on delivery.

  • Title in the Products passes to you upon receipt of full payment.

  • We are not liable for delays outside our control (including courier disruptions, strikes, or natural disasters).

6. Returns & Refunds

  • We comply with the Australian Consumer Law (ACL). You are entitled to a refund or replacement for faulty, damaged, or misdescribed Products.

  • To claim, you must contact us within 7 days of delivery at info@theessentialway.com.au with proof of purchase.

  • For hygiene reasons, we cannot accept returns for change of mind on skincare and wellness products once opened or used.

  • Refunds will be issued to your original payment method within 7–10 business days once approved.

7. Product Safety & Disclaimer

  • All Products are formulated and manufactured to Australian standards.

  • Ingredient lists are provided to assist with allergy considerations.

  • Results may vary between individuals. Our Products are not intended to diagnose, treat, cure, or prevent medical conditions.

  • Always patch test prior to use. Stop use if irritation occurs.

8. Intellectual Property

  • All trademarks, logos, packaging, product designs, text, photographs, and formulations are the intellectual property of The Essential Way.

  • You may not copy, reproduce, distribute, or use our content without prior written consent.

9. Limitation of Liability

  • To the fullest extent permitted by law, we exclude liability for indirect, incidental, or consequential loss.

  • Our total liability for any claim arising out of the supply of Products is limited to the amount paid by you for those Products.

  • Nothing in these Terms excludes rights under the ACL that cannot be lawfully excluded.

10. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses resulting from your breach of these Terms or misuse of our Products. 

11. Privacy

We are committed to protecting your privacy. Please refer to our Privacy Policy for how we collect, store, and use your personal data.

12. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the Victorian courts.

15. Changes to Terms

We may update these Terms at any time. Updates will take effect when published on the Site.

16. Promotions & Offers

  • Promotions, discount codes, or special offers are only valid during the stated promotional period.

  • Only one promotion code may be applied per order unless otherwise specified.

  • Discounts cannot be applied retroactively to completed orders.

  • Exclusions may apply (e.g. gift vouchers, limited edition products).

17. Wholesale & Resale Restrictions

Our Products are sold for personal use only.

  • We do not permit individuals or businesses to purchase our Products for resale or redistribution without written approval.

  • Any orders suspected of resale may be cancelled at our discretion.

18. User Content & Feedback

  • By submitting reviews, feedback, photos, or testimonials to us (including via social media), you grant The Essential Way a non-exclusive, royalty-free licence to use that content for marketing purposes.

  • You warrant that any content you provide is accurate, non-defamatory, and does not infringe third-party rights.
